The Plaintiffs allege that Delta-T is a temporary staffing agency, that they were misclassified as independent contractors (are were in fact Delta-T employees), and that as a consequence they are owed compensation for unpaid overtime wages, rest and meal breaks violations, failure to reimburse business related expenses, and failure to provide other benefits provided for under California law.
The Defendant, Delta-T, claims it is a referral agency that provides independent contractors in the behavioral healthcare business to its clients (clinics, hospitals, treatment facilities and other healthcare related organizations), and that Delta-T merely sets up an introduction and it is Delta-T’s clients who actually negotiate and enter into working relationships and agreements with the Plaintiffs.
Although the court has not yet addressed the merits of the claims, and has merely granted class certification, any employer using independent contractors should keep abreast of the court’s future rulings in this case.
