California Landlords Must Provide a 60-Day Notice to Evict a Tenant

Under California law, a landlord seeking to evict a tenant for a "no fault" reason must provide the tenant with a 60-day notice to terminate. See Civil Code Section 1941.1. A 30-day notice to terminate is sufficient if the tenant has lived in the property for less than one year, or if the landlord has sold the property and certain requirements are met. The 60-day notice requirement also does not apply to a fixed-term lease, such as a one-year lease. Other notice laws address tenants in properties foreclosed upon. Typically, a tenant in good standing (one who has paid his or her rent on time and in full) residing in a residential property that has been foreclosed upon is entitled to remain for the balance of any lease term and if month-to-month then to a 90-day notice to vacate under federal law.
