California Law on Hiring Unpaid Interns

On March 14, 2012, in New York, Lucy Bickerton filed a class action lawsuit against Charlie Rose and Charlie Rose, Inc., on behalf of herself and all other unpaid interns.

According to the Complaint:

“Unpaid internships have proliferated among white collar professions, especially in fields like politics, film, fashion, journalism and book publishing. However, the practice of classifying employees as ‘interns’ to avoid paying wages runs afoul of state wage and hour laws, which require employers to pay all workers who are ‘permitted or suffered to work’ the minimum wage and overtime.”

Your Employer’s Computer Use Policy

In California, at least for now, violating an employer's Computer Use Policy is no longer a violation of the Computer Fraud and Abuse Act.

On April 10, 2012, the Ninth Circuit Court of Appeals held in United States v. Nosal, that employers may no longer rely on the Computer Fraud and Abuse Act (18 U.S.C. §1030) to threaten or bring federal criminal prosecution against employees who violate their computer use restrictions.
