In General
I have extensive experience in interpreting
the array of state and federal laws affecting advertising in the mainstream
media channels and over the Internet. As businesses in every industry
adapt to the Internet, they expand their dissemination of content, generally
in some form of advertising. I counsel my client on content clearance
to prevent lawsuits and help my clients license and defend their rights
to their information, their trademarks, domain names, logos, and content
including prose, music, photographs, videos, film, animation, and graphics.
Rights Acquisition, Licensing, and
Protection
I protect my clients content by obtaining,
enforcing, and protecting rights to intellectual property including copyrights,
trademarks, and service marks. I am well-versed in the new anti-cybersquatting
laws and requirements for clearance. I represent both licensees and licensors
in transfers of rights to content.
Content Clearance
I counsel my clients on issues to prevent
claims based on allegedly false, defamatory, or invasively private information.
By providing pre-clearance review, I protect clients against lawsuits
alleging misappropriation of copyrighted material, trademarks, trade secrets,
and celebrity names and likenesses. To that end, publishers, advertisers
and entertainment companies have retained me to provide pre-clearance
advice on news articles, advertising copy, television commercials, films,
and screen plays.
Representative industries include publishing, e-commerce, entertainment,
novelty items, advertising, retail, and service enterprises.
